The Justice Department's recent aggressive efforts to enforce the Foreign Corrupt Practices Act in the U.S. and abroad have spawned waves of compliance training and corporate certification. As some corporations have learned the hard way, culpability under the Act turns on just three words, "in furtherance of." Specifically, liability will lie if a company commits an act "in furtherance of" an improper payment to a foreign official. And companies are learning that it takes far less than a suitcase full of cash to draw the attention of the Justice Department. Acts as mundane as sending an email, transmitting a fax, or, as in a recent case, shipping products may figure prominently in an indictment. This webinar will discuss the DOJ's current FCPA enforcement approach as reflected in the agency's expansive reading of the FCPA statutory provisions, such as the "in furtherance of" clause.
