Federal Energy Regulatory Commission Enforcement Update

With the enactment of the Energy Policy Act of 2005, the Federal Energy Regulatory Commission (FERC or Commission) – a traditional economic regulator whose enabling statutes date back to 1906 – truly became a Federal enforcement agency because, inter alia, it received the authority to impose penalties of $1 million per violation per day. No other Federal agency has greater penalty authority.
